Terms of Use

These Terms of Use ("Terms") govern your access to and use of SomexAI App Manager (the "App") and related websites and services (collectively, the "Service"), provided by SomexAI Applications Group, LLC ("SomexAI", "we", "us", or "our"). By using the Service, you agree to these Terms.

1. Eligibility and Accounts

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information and keep it updated.

2. Subscriptions, Trials, and Billing

• Trial: The Service may offer a 14-day trial with full features. A valid payment method may be required to start the trial.
• Auto-renewal: Subscriptions renew automatically unless cancelled before the renewal date.
• Billing platform: For Android, purchases are processed by Google Play Billing. Subscription management (including cancellation) is handled through your Google Play account.
• Changes: Pricing, plans, and features may change. Changes apply prospectively as permitted by law and store policies.

3. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes.
• Attempt to gain unauthorized access to the Service or other users’ data.
• Upload malware or interfere with the Service’s normal operation.
• Reverse engineer or attempt to extract source code except where permitted by law.
• Use the Service to violate third-party rights or applicable regulations.

4. Plan Limits and Fair Use

Your plan may include limits (e.g., number of apps, team members, QA assignments, AI usage, storage). If you exceed a limit, some actions may be blocked until you upgrade or reduce usage. Trial-expired workspaces may be read-only until a subscription is activated.

5. Content and Data

• Your content: You retain ownership of the data you submit to the Service.
• License to operate: You grant us a limited license to host, process, and display your content solely to provide the Service.
• Feedback: If you provide feedback or suggestions, you grant us permission to use them without restriction or compensation.

6. Intellectual Property

The Service, including software, design, and trademarks, is owned by SomexAI or its licensors and is protected by law. These Terms do not grant you ownership rights in the Service.

7. Third-Party Services

The Service may integrate with third-party services (e.g., GitHub, Google, RevenueCat). Your use of those services is governed by their terms and policies. We are not responsible for third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMEXAI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for security, legal, or operational reasons. Certain sections of these Terms survive termination.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict of laws principles.

12. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice as required by law. Your continued use of the Service after the effective date means you accept the updated Terms.
